Who must register

All owners of residential rental units within the city limits, for tax years beginning on or after January 1, 2018. If a building contains more than one dwelling unit, each counts as a separate residential rental unit. Renting out housing is a business activity under the Business License Law and requires a tax account with the Revenue Division. Exempt from registration (PCC 7.02.890 C and D): those who rent only a space for a mobile home, recreational vehicle or floating home moorage, but not the structure itself; and housing regulated as affordable to households at or below 60% of median income under HUD guidelines. Source discrepancy: subsection D of the code speaks of an exemption from registration, while Administrative Rule LIC-5.09 states that all units must register even when no fee is assessed.

Penalty for operating unlicensed

Verbatim from Administrative Rule LIC-5.09: "The civil penalty under 7.02.700(E), for failing to register residential rental units with the Revenue Division may be up to 100 percent of the per unit fee for each unit." Each unreported unit is a separate violation of the requirements of PCC 7.02.890; the penalty applies even to units for which no fee is assessed. Late payment of the fee draws penalties and interest under PCC 7.02.700 and 7.02.710 A (beginning with tax year 2019).
